Terms of Service

These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and Turi Design Studio, LLC ("we," "us," or "our"), concerning your access to and use of the turi-group.com website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collectively, the "Site").

By accessing the Site and/or using our services, you agree that you have read, understood, and agreed to be bound by all of these Terms of Service. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS OF SERVICE, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SITE AND YOU MUST DISCONTINUE USE IMMEDIATELY.

Turi Design Studio provides residential architectural design services including, but not limited to:

• Custom floor plan development
• Architectural elevations and renderings
• Construction documentation
• Permit-ready plan sets
• Design consultation and advisory services

Specific services, deliverables, timelines, and pricing will be outlined in individual proposals and contracts provided to clients.

By using the Site, you represent and warrant that:

1. You have the legal capacity and you agree to comply with these Terms of Service
2. You are not a minor in the jurisdiction in which you reside
3. You will not access the Site through automated or non-human means
4. You will not use the Site for any illegal or unauthorized purpose
5. Your use of the Site will not violate any applicable law or regulation

Proposals and Contracts

All design services require a signed contract and deposit before work begins. Proposals outline scope, deliverables, timeline, and investment. Signing a proposal constitutes acceptance of these terms.

Payment Terms

Standard payment terms are 50% deposit upon contract signing and 50% upon final delivery. Specific payment schedules may be outlined in individual contracts. Payment is required before final files are released.

Deposits

Deposits are non-refundable once work has commenced. In the event of project cancellation by the client after work has begun, the deposit will be retained to cover work completed to that point.

Timeline and Delivery

Estimated timelines are provided in good faith based on current workload and project complexity. We commit to meeting agreed-upon deadlines. Delays caused by client feedback, additional scope requests, or circumstances beyond our control may extend the timeline accordingly.

Our Rights

Unless otherwise stated, the Site and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the "Content") and the trademarks, service marks, and logos contained therein (the "Marks") are owned or controlled by us.

Project Files and Ownership

Upon full payment, clients receive a limited license to use the delivered design files for the specific project for which they were created. This includes the right to build one instance of the designed structure, submit plans for permits, and use for construction purposes.

Restrictions

Clients may not:

Resell or redistribute the design files to third parties

Use the design for multiple projects without additional licensing

Reverse engineer or recreate the design for use on other projects

Claim authorship of the design

Remove our copyright notices from the files

Portfolio Rights

We reserve the right to use completed projects in our portfolio, marketing materials, and website. If confidentiality is required, this must be specified in writing before project commencement.

Each service package includes a specified number of revision rounds as outlined in the proposal. Additional revisions beyond those included may be subject to additional fees at our posted standard hourly rate. Substantial scope changes may require a new proposal and additional payment.

Clients agree to:

• Provide all necessary information, including site surveys, lot dimensions, zoning requirements, and style preferences
• Respond to design reviews and requests for feedback within agreed-upon timeframes
• Make timely payments according to the contract terms
• Obtain all necessary permits and approvals for construction
• Verify all dimensions and specifications before construction begins
• Hire qualified contractors to build according to the plans

Turi Design Studio provides design services to the best of our ability based on information provided by the client. However, we are not responsible for:

• Errors or omissions in client-provided information (site surveys, zoning requirements, etc.)
• Changes required by permit reviewers or building departments
• Construction errors or deviations from the plans by contractors
• Cost overruns or budget estimates that prove inaccurate
• Soil conditions, environmental issues, or other site-specific conditions
• Structural engineering (unless specifically contracted separately)

IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE SITE OR SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

You agree to defend, indemnify, and hold us harmless, including our subsidiaries, affiliates, and all of our respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys' fees and expenses, made by any third party due to or arising out of: (1) use of the Site; (2) breach of these Terms of Service; (3) any breach of your representations and warranties set forth in these Terms of Service; (4) your violation of the rights of a third party, including but not limited to intellectual property rights; or (5) any overt harmful act toward any other user of the Site with whom you connected via the Site.

These Terms of Service and your use of the Site are governed by and construed in accordance with the laws of the State of Texas applicable to agreements made and to be entirely performed within the State of Texas, without regard to its conflict of law principles.

Informal Negotiations

To expedite resolution and control the cost of any dispute, controversy, or claim related to these Terms of Service, we and you agree to first attempt to negotiate any dispute informally for at least thirty (30) days before initiating arbitration.

Binding Arbitration

Any dispute arising out of or in connection with this contract, including any question regarding its existence, validity, or termination, shall be referred to and finally resolved by arbitration under the rules of the American Arbitration Association. The seat of arbitration shall be Travis County, Texas.

These Terms of Service shall remain in full force and effect while you use the Site or engage our services. We may suspend or terminate your access to the Site and services at any time, without prior notice, if you breach these terms.

Clients may cancel projects at any time; however, deposits are non-refundable and any work completed to the date of cancellation will be billed at our standard hourly rate.

We reserve the right to change, modify, or remove the contents of the Site at any time or for any reason at our sole discretion without notice. However, we have no obligation to update any information on our Site. We also reserve the right to modify or discontinue all or part of the Site without notice at any time.

Architectural design services are provided in accordance with applicable state and local regulations. Where required by law, final construction documents will be reviewed and stamped by a licensed architect. Clients are responsible for verifying all requirements with their local jurisdiction.
